<dc:description xml:lang="en-US">Murabahah is a form of buying and selling goods developed by Islamic banking. In Islamic banking, murabahah dominates the bank's income from the products available in all Islamic banks. Murabahah also provides many benefits to Islamic banks/Islamic banks, one of which is the profit that arises from the difference between the purchase price from the seller and the selling price to the customer. Murabahah as an exchange transaction contract requires the seller to have the right to take legal action against the object he sells. In addition, murabahah as a form of trust buying and selling requires the seller and the buyer to know each other and be honest with each other regarding the object of sale, both the specifications of the goods, the acquisition price, the desired margin, and the method of payment. Included in the acquisition price is the cost of goods and their procurement costs until the acquisition price is only known after the goods are legally owned by the seller. Along with the emergence and development of the Islamic banking industry, murabahah was adopted as one of the contracts in Islamic bank financing products.</dc:description>

The basic principles of sharia banking are the principles of free maghrib (maysir, gharar, haram, usury, and batil), trust and prudence in the management of sharia banking activities, and principles based on contracts. Differences Islamic Banks and Conventional Banks:. The profits obtained by the business are in accordance with the initial agreement as stated in the contract. However, if there is a loss, it will be borne by the Islamic bank if the loss is not due to the intention of the insurer's customer, while the customer loses time, energy and thought. However, the mudharabah financing at one of the Islamic banks has not shown the character of the mudharabah financing completely and correctly because the concept of debt appears in the contract.

<dc:description xml:lang="en-US">Lease transactions in conventional banking do not transfer property rights, which means that when the lease expires, the goods are returned to the owner of the leasing object, which generally does not require the services of a financial institution. Another case in practice is because of Islamic banking financing which is known under a lease agreement called ijarah. In Islamic banking, al-ijarah is divided into 2 types, namely mutlaqah ijarah or leasing, operating lease is a process that we usually encounter in daily economic activities. In the context of Islamic banking, ijarah is a lease contract in which a bank or financial institution rents out equipment, buildings or goods, to one of its customers by charging a fee that has been determined with certainty in advance. Meanwhile, al-Ijarah al-Muntahia bit-Tamlik is a kind of fusion between a sales and lease contract or a lease contract which ends with the ownership of the goods being in the hands of the lessee. The nature of the transfer of ownership also distinguishes it from ordinary leases, which exist in conventional financial institutions. The concept of al-Ijarah in Islamic banking as a lease in general, but what distinguishes it is that in Islamic banking there is a lease which at the end of the contract, the customer is given a choice/option to own the goods or not, generally called a lease purchase.

One of the contracts that often occurs in the community is the murabahah contract. Murabahah is a sale and purchase agreement between the bank and the customer. Islamic banks buy goods needed by customers and then sell them to the customer concerned at the acquisition price plus a profit margin agreed between the Islamic bank and the customer.</dc:description>

<dc:description xml:lang="en-US">Children are an important part of the younger generation who play a strategic role in shaping better families. Therefore, children need adequate guidance and protection to ensure their physical, psychological, mental, and social growth and development. This research discusses the management of orphaned children's assets in Gampong Mongeudong and the review of Islamic law and the Marriage Law on the management of orphaned children's assets. The research method used is field research conducted in the real life of the community. The results of the research show that the management of orphaned children's assets is done by family members, including fathers, mothers, grandmothers, or uncles. However, the process of determining the guardian of orphaned children does not comply with the provisions of the law. From the perspective of Islamic law, the maintenance of orphaned children's assets should be carried out by the guardian who is the closest relative in the line of guardianship. However, this guardianship must comply with several provisions, including the prohibition for the guardian to mix their assets with the assets of the child under their guardianship, the prohibition to excessively consume the child's assets, and the obligation to return the child's assets when the child reaches adulthood.</dc:description>

Unfortunately, Sharia Financial Institutions have not played an active role in channeling cooperation-based financing. Instead, they have mostly focused on channeling murabahah financing under the buying and selling scheme. However, Sharia P2P Lending can help develop the real sector and have a positive impact on the national economy by reducing bureaucracy and complicated requirements. Sharia P2P Lending is an investment platform in real sector businesses that benefits business actors and investors. The use of Sharia P2P Lending can encourage the public to invest in the real sector because of the following reasons: (1) it provides a safe investment with higher returns compared to conventional investments, (2) it offers access to invest in the real sector with relatively small capital, (3) it allows investors to choose business actors and monitor their investment performance, (4) it has relatively low transaction costs and is easy to conduct transactions online, and (5) it provides protection through risk management and financing management policies carried out by the company.</dc:description>

The research method used is literature analysis and literature review. In this study, it was found that the development of digital technology has significant implications for the fields of law and Sharia, especially in the context of digital culture. Some of the challenges faced include issues of privacy, data security, validity of online transactions, as well as ethical and moral issues in the use of digital technology. The research results show that law and Sharia must continue to evolve to cope with the rapid changes in digital culture. This involves a deep understanding of the principles of law and Sharia and their application in the digital context. Furthermore, it is important for legal and Sharia practitioners to address emerging challenges in the digital culture, including engaging in collaborations among legal, Sharia, and technology experts to tackle complex issues. This research contributes to the understanding of legal and Sharia challenges in the digital culture and provides a basis for policy-making and relevant regulatory development to address the rapidly changing digital culture. This research is expected to provide guidance and direction for legal, Sharia, and technology practitioners in navigating the evolving digital culture</dc:description>

Then the data analysis technique used is starting from Data Reduction, Data Presentation and Conclusion. The research results of the wakalah contract applied at UPZ Madura are in accordance with the regulations of all UPZ IAIN Madura work programs which are in accordance with the meaning of the wakalah contract, namely the handing over of the mandate from muzakki to UPZ IAIN Madura. The requirement to become a manager must be truly trustworthy as one must be able to trust and be transparent in the management of ZIS finances (Zakat, Infaq and Sedekah). Muzakki who have donated their funds to UPZ IAIN Madura means that they have trusted UPZ IAIN Madura to be able to manage the funds from Muzakki. As a contribution from zakat managers which UPZ IAIN Madura must manage and distribute properly. Seeing from sharia economic law, the application of the wakalah contract at UPZ IAIN Madura has been carried out well. Because, looking at all aspects that occur related to zakat, infaq and alms, it is included in the special provisions in Islamic law. With this wakalah contract, Muzakki does not arbitrarily give trust to UPZ IAIN Madura to manage and distribute these funds to those in need. UPZ IAIN Madura provides funding facilities from orphans, the dhuafa and the poor/poor people</dc:description>

<dc:description xml:lang="en-US">Many MSME producers of processed food put halal writing on the packaging, either only with ordinary Latin and Arabic writing, or accompanied by the MUI halal logo and in terms of the main raw materials or additional ingredients, it is difficult to declare the origin of the ingredients to be halal. In fact, the clarity of a food product is the most important thing so that consumers know that the product they are consuming is a halal product and the origin of the ingredients is clear. This study uses a type of normative legal research with a statute approach and a textual approach. This research was approved to be conducted on 19 November 2021, while this research took place on 1 March 2022 BPJPH established a new halal label that applies nationally. For this reason, with this stipulation there is a transfer of the authority of the institution that issues halal certificates from the LPPOM-MUI institution to BPJPH under the Ministry of Religion, this design change is part of the transfer of authority for halal certificates to BPJPH. The results of the study show that: First, the production activities of the three SMEs in Pamekasan, namely UD. Nayla AZ, Kitchen AIM Talang Siring, in the process of procuring materials to distribution, which was carried out in practice, there were no activities and facilities contaminated with unclean/unlawful objects, apart from that no critical activities were found that could cause a product to be unlawful. Whereas at Tarqiyah in its critical activity it was found that the use of raw materials in the form of petis did not have a halal label. Second, the results of the analysis that the researchers carried out using MUI fatwa No. 4 of 2003 concerning the standardization of halal fatwa indicates that MSME products at Tarqiyah, namely BAPER, do not comply with 100% halal principles in accordance with LPPOM-MUI principles. Because the raw materials used are not labeled halal, so the origin of the materials, processes, and facilities used is not known, not only that, materials that are not labeled halal are also included in critical activities that cause a product to be non-halal.</dc:description>

<dc:description xml:lang="en-US">This research is about studying the concept of "advantages of syirkah al-inan from the perspective of the Islamic Economic System". To achieve the above objectives, the author applied the following methodology in his research: Collecting data/information from a number of libraries and institutions; Field studies by studying Bank Rakyat data to add the information needed. The interview method is used to conduct interviews with respondents who are directly involved with the research topic, for example Managers and Sharia Administrators at the bank; and Relying on the Al-Quran, Hadith, opinions of Ulama whose opinions have been embedded in famous books and studies carried out by contemporary Islamic thinkers. Based on this research, the author is able to understand the concept of profit in syirkah al-Inan from an Islamic economic perspective. The author found that musyarakah or syirkah is a form of cooperation between two or more people to carry out a business or activity motivated by profit. Musyarakah is an instrument offered by Bank Rakyat. Therefore, this research will describe the problem of syirkah al-inan from the perspective of Islamic law and its application, especially at Bank Rakyat and conclude whether the concept used is in accordance with Islamic sharia or not. If we observe the opinions of the schools of thought we find that there are two main concepts in profit sharing. Based on the Syafie school of thought, profit sharing is based on the ratio of capital injected by partners. The second profit sharing concept is based on what has been previously agreed without reference to the ratio of capital injected. The second concept is based on the Imam Hanafi school of thought. Based on observations made, it was found that Bank Rakyat has implemented the Islamic Sharia Banking concept, especially in the problem of profit distribution in its musyarakah products. Therefore, the issue of profit sharing is very important not only as an index to determine the success or failure of a partnership, but also as a benchmark that the targeted profits for the company have been achieved. Therefore, the model used in sharing profits based on sharia requires a clear response and never fails. The author hopes that this research can become a useful guide for society</dc:description>

<dc:description xml:lang="en-US">Leasing is a right commonly exercised by the community and is one form of interaction that is often carried out. The problem in this study is about the practice of Car Rental according to Law Number 22 of 2009 concerning traffic rules and Sharia Economic Law that occurs at CV Galeri Rental in Banda Sakti District, Lhokseumawe City. The formulation of this research problem, namely: 1) How is the practice of car rental at CV Galeri Rental Lhokseumawe City? 2) How is the analysis of sharia economic law and Law 22 of 2009 concerning traffic offences on car rental practices at CV Galeri Rental? This research is field research, using qualitative research methods. The approach method in this research uses empirical-juridical method. The techniques used in collecting data in this research are through observation, interviews and documentation. The results of the research show that the provisions regarding rights and obligations in the implementation of car leases at CV Galeri Rental are contained in a lease agreement in which the terms and conditions including rights and obligations are regulated. Case settlement due to negligence by the tenant in the car rental agreement at CV Galeri Rental in the form of damage or delay, the rental party refers to the agreement letter owned by CV Galeri Rental. In accordance with Law Number 22 Year 2009 Article 234. According to the view of Sharia Economic Law on the practice of Leasing, the original law is mubah (permissible), as long as it does not conflict with the rules set out in the Quran, Hadith and Ijma'. Likewise, the practice of car rental leasing that occurs at CV Galeri Rental Lhokseumawe City is also permissible, because the lease and the benefits are good for both the tenant and the renting party. But in the practice of renting a car rental, the renting party does not determine the rental time limit, but depends on the car renter how many days he wants to rent out his car.</dc:description>

They also carry out a tradition of donating called "potangan" which means bequeathing some of their wealth in the hope that it will be returned during future celebrations. With this phenomenon, how Islam responds to the phenomenon of the cutting system is through the tradition of contributing to the Ulujami.</dc:description>

<dc:description xml:lang="en-US">Sharia-based Peer-to-Peer (P2P) lending has become one of the funding alternatives for Micro, Small, and Medium Enterprises (MSMEs) in Indonesia that have limited access to capital from conventional banks. By using Sharia principles, this P2P lending aims to provide funding services that follow Islamic values and are open to MSME players. Research objectives: This study aims to analyze the role, effectiveness, and challenges of Islamic P2P lending financing in supporting the development of MSMEs in Indonesia and assess its compliance with Islamic economic principles. Research method: This research uses a qualitative approach with a literature study method and in-depth interviews with several MSME players and Islamic P2P lending service providers. Secondary data were obtained from reports and publications of the Islamic fintech industry, while primary data were collected through interviews that were thematically analyzed. Research results: The results show that Islamic P2P lending financing can provide significant alternative funding for MSMEs in Indonesia, especially in terms of accessibility and flexibility. However, there are challenges related to regulation and public education on Islamic financing. The Sharia-compliant P2P lending system also attracts MSMEs that are committed to the halal economy, although there is a need for improvement in the transparency aspect.</dc:description>

This library research was conducted by studying books and journals that are relevant to the writing of this article. In the Islamic perspective there is no nomenclature implicitly mentioning prostitution. Prostitution is the provision of sexual services by a man or a woman for money or satisfaction. Prostitution or prostitution is defined as adultery. Prostitution is a practice that destroys the foundations of family life, morality, morality, law and religion. In the Qur'an it is explained that the appropriate punishment for adulterymuhsan in the form of punishment of stoning and adulteryghairu muhsan was subject to a penalty of 100 lashes. Give punishment to the perpetrators of prostitution to prevent the occurrence of acts of adultery that can damage the sustainability of human life, especially aspects dharuriat, namely maintenance hifz al-nasl. Punishments are given in order to create sharia goals and punishment in Islamic law which includes prevention and guidance can be achieved and creates a deterrent effect for perpetrators, and not to repeat the act.

<dc:description xml:lang="en-US">This study aims to analyze the Regulation of the Minister of Trade Number 31 of 2023 which regulates the use of TikTok as an e-commerce platform from the perspective of Sharia Economic Law. TikTok, which was originally a social media platform, has now transformed into one of the e-commerce platforms that is popular with the public, especially the younger generation. This Regulation of the Minister of Trade provides regulations related to business permits, transparency, and transaction security, which aim to protect consumers and business actors. However, from the perspective of Sharia Economic Law, there are principles such as justice (al-‘adl), balance (al-mizan), and welfare (maqashid syariah) that must be met. This study uses a normative juridical method with an analytical descriptive approach to identify the conformity of these regulations with Sharia principles, as well as the impact of regulations on halal and profitable digital economic activities. The results of the study show that Permendag Number 31 of 2023 is largely in line with the principles of Sharia Economic Law, namely prioritizing aspects of fairness and transaction security, but several points still require further adjustment to be more in line with Sharia values. This study provides recommendations to the government to pay attention to Sharia aspects in the development of digital economic regulations in Indonesia.</dc:description>

<dc:description xml:lang="en-US">Abstract: Dowry in marriage is the right of a wife which is the obligation of the husband, in Acehnese customs the dowry is generally in the form of gold. Dowry known as jeulamee or jeunamee has a different value in each district/city in Aceh, some have a value of 1 (one) may equivalent to 3.3 grams, and some have a value of 1 mayam equivalent to 3 grams. The problem arises when the price of buying and selling gold increases, which makes some people postpone their marriage because gold is getting more expensive daily, plus the dowry that must be prepared ranges from 10-30 mayam. Related to this problem, how do das sein and das sollen Pidie society determine the amount of dowry, and how do the parties decide when the price of buying and selling gold increases. Qualitative research is the method used, focusing on field research as a primary source. The first finding in the practice of the Pidie community, das sein society should have married when they were financially and emotionally ready plus an understanding of religion related to the household to avoid unnecessary conflicts. However, Das Sollen found that some people postpone their marriage because of capital constraints, including the dowry which is not a small amount plus the reception or walimatul ursy which also requires large capital. The family in this problem has different views or opinions on how to deal with this problem, generally, both parties will take a middle path in the form of deliberation to achieve win-win solutions.</dc:description>

<dc:description xml:lang="en-US">This research focuses on the application of ujrah discounts in pawn products implemented by Bank Syariah Indonesia (BSI) Bojonegoro Branch Office and analyzes its conformity with the principles of Sharia Economic Law. Sharia pawning, as one of the superior products of sharia banking, involves a contract between the bank and the customer where the customer hands over goods as collateral for the loan provided by the bank. In this agreement, the bank charges an ujrah fee in exchange for storage and maintenance services for collateral. However, with increasingly tight competition between sharia financial institutions, BSI KC Bojonegoro developed a marketing strategy in the form of providing discounts on ujrah fees applied. The research method used is qualitative-descriptive with data collection techniques through interviews, observation and documentation. The research results show that providing ujrah discounts at BSI KC Bojonegoro is carried out as a marketing strategy to attract customers and increase competitiveness. From the perspective of Sharia Economic Law, the application of this discount is considered in accordance with sharia principles as long as it does not violate the terms of the contract and transparency is maintained.</dc:description>

This study aims to determine the implementation of buying and selling without price tags in Angkringan and buying and selling food without price tags from the perspective of Law No. 8 of 1999 and Islamic Law. This research methodology uses field research and qualitative research. The data sources used are primary data sources and secondary data sources. This research is located in Angkringan, Ngringo Village, Jaten District, Karanganyar Regency. Data collection techniques are carried out through observation, interviews, and documentation. The data analysis techniques used are data reduction, data presentation, and conclusions. The results of this study can be concluded that the implementation of buying and selling food at the Angkringan of Ngringo Village, Jaten District, Karanganyar Regency is carried out by taking or ordering a system, then eating and paying at the end. Five Angkringan business actors are passive regarding price information, and there is one business actor who takes the initiative to include prices. Buying and selling without a price tag violates the provisions of Article 7 of Law Number 8 of 1999. A contract, already contains elements of jahalah, ikrah, dharar, so the sale and purchase are said to be khiyar disgrace.</dc:description>

<dc:description xml:lang="en-US">The concept of Musyarakah Mutanaqishah contract is one form of partnership contract in Islamic banking that is rapidly developing as an alternative financing, where the bank and the customer together provide capital for a business and the bank will gradually reduce ownership of the business along with payments by the customer. In this contract, the customer does not only act as a borrower, but also as a partner in sharing profits and losses based on the proportion of each capital contribution. The implementation of Musyarakah Mutanaqishah in Islamic banking provides a solution for financing the purchase of assets such as houses or vehicles while maintaining sharia principles, including the prohibition of usury, gharar, and maysir. In practice, the Musyarakah Mutanaqishah contract is not only beneficial for both parties, but also provides a sense of justice and transparency in transactions. However, the implementation of this contract still faces challenges in terms of operations, regulations, and market understanding that need to be continuously developed in order to maximize its benefits. This article aims to analyze the basic concept of Musyarakah Mutanaqishah, its implementation mechanism in Islamic banking products, as well as the challenges and opportunities faced in its implementation.</dc:description>

<dc:description xml:lang="en-US">Risk management in Islamic financial institutions presents a unique challenge due to the dual necessity of aligning with conventional management practices and the legal-ethical framework of Sharia. The central problem of this research is the lack of integration between evolving risk management practices and the foundational principles of Sharia Economic Law, which often leads to either operational inefficiency or potential non-compliance with Islamic legal norms. This disconnect becomes more critical due to increasing financial complexity, technological innovation, and regulatory demands. Therefore, this study addresses the following research question: How is risk management transforming within Islamic financial institutions, and to what extent does this transformation comply with the principles of Sharia Economic Law? The study also explores whether such transformation strengthens the Islamic finance sector's legal certainty, stakeholder trust, and institutional resilience. This research adopts a qualitative-descriptive method with a normative legal approach. Data were collected through document analysis of legal provisions, fatwas, and risk management frameworks used in selected Islamic financial institutions. In-depth interviews with Sharia board members and risk officers from Islamic banks were also conducted to capture practical insights and legal reasoning. The findings show that the transformation of risk management in Islamic financial institutions is occurring on three fronts: technological adoption (e.g., AI and big data for risk analysis), regulatory compliance alignment (integration of OJK and DSN-MUI standards), and internal policy development grounded in maqashid al-shariah. However, the study finds inconsistencies between implementation and Sharia legal standards, particularly in credit and liquidity risks, where conventional models are still dominant. The research concludes that a robust Sharia Economic Law framework and ethical managerial reform is essential to ensuring that risk management practices in Islamic financial institutions mitigate risk and uphold Islamic legal and moral obligations</dc:description>

<dc:description xml:lang="en-US">This study analyzes the legal compliance of cooperatives in implementing sharia financing and the role of the Sharia Supervisory Board (DPS) in maintaining compliance with sharia principles, as well as the obstacles faced. This research is an empirical juridical research that reviews the implementation of the Regulation of the Minister of Cooperatives and Small and Medium Enterprises Number 16/Per/M.KUKM/IX/2015 and DSN-MUI Fatwa No. PER-01/DSN-MUI/X/2017. The approach used is a legislative approach. The data in this study was analyzed using a qualitative descriptive method. The results of the study show that the main obstacle faced is the problem of liquidity, especially when there is a massive withdrawal of funds ahead of the holiday, as well as the low understanding of members on the principle of muamalah. Cooperative compliance with related regulations is supervised by DPS and reported to DSN-MUI. However, supervision and education still need to be improved. It is necessary to strengthen liquidity reserves, improve fund disbursement procedures, and continuous training for DPS and cooperative members to improve Islamic financial literacy and the effectiveness of cooperative operational supervision. This research contributes to strengthening the understanding of cooperative law compliance and the strategic role of the Sharia Supervisory Board (DPS) in maintaining sharia compliance and cooperative operational stability, as well as providing practical recommendations for strengthening supervision and education of cooperative members.</dc:description>

<dc:description xml:lang="en-US">The development of science demands the actualization of humanity in various aspects of life. The most obvious impact of this modernization is the emergence and growth of various new problems, especially within the scope of Islamic law. Often, the various problems we face require us to seek solutions from a Muslim perspective. In response to these disappointments, contemporary fiqh has emerged as a discipline worthy of in-depth study. This paper contains an explanation of the implicit form of contemporary fiqh, both in terms of its meaning, object, and field of study, the differences between contemporary fiqh and fiqh fiqh, and the importance of studying contemporary fiqh for every Muslim. The research technique used is documentary research with a descriptive and clear background, with the aim of explaining the study precisely and in-depth. The conclusion of this study is that contemporary fiqh (Islamic jurisprudence) is a problem in Islamic law that exists in the current or contemporary era and was not encountered in the era of the Prophet Muhammad or his companions. Therefore, its legal status must be determined through the ijtihad process of mujtahids, referring to fundamental sources of Islamic law, such as the Quran, hadith, and others. </dc:description>

APBN management reflects the state's commitment to realizing public welfare through targeted resource allocation. This article aims to examine various types of state expenditure within the APBN structure, including personnel expenditure, goods expenditure, capital expenditure, debt interest payments, subsidies, grants, social assistance, other expenditures, and transfers to regions. Using a descriptive-analytical approach, this article discusses the role and function of each type of expenditure in supporting national development and public services. Understanding the structure of state expenditure is expected to contribute to the evaluation of fiscal policy and the strengthening of state financial governance. The conclusion of this study confirms that optimizing state expenditure allocation is key to achieving inclusive and sustainable development.</dc:description>

<dc:description xml:lang="en-US">Mujtahids do not create, but only discover laws. This is because of the Islamic belief that laws are created by God as the lawmaker (al-Shari'). Humans/mujtahids only understand (fiqh) the divine law. The process of understanding the law is called istinbaht al-hukm through an intellectual activity called ijtihad. The legal results obtained through istinbath ijtihad are called fiqh. The purpose of discovering the law must be understood by mujtahids in order to develop legal thought in Islam in general and address contemporary legal issues whose cases are not explicitly regulated by the Quran and Hadith. Therefore, by applying various methods, it is hoped that laws can be found to solve various problems that arise. This journal will attempt to describe the ta'lili method of discovering law. Based on a study of the concepts of ta'lili reasoning regarding the distribution of kaffarat oaths to non-Muslims, conclusions can be drawn, namely: First, the obligation to pay kaffarat oaths as contained in the Al-Qur'an surah al-Maidah verse 89, is mukhayyar, namely freeing slaves, providing food or clothing, if you are unable to carry out these three things, you are obliged to fast for three days. Second, Abu Hanifah r.a. does not require a believing slave to be the target of an oath of infidelity. Abu Hanifah r.a. does not turn the word muthlaq away from muqayyad, he gives charity to the common word (muthlaq). Third, it is permissible to free ahl al-dzimmah (non-Muslim) slaves as sworn inmates and also provide food or clothing to ahl al-dzimmah (non-Muslims). Because of the statement on the issue of distributing kafarat oaths, there is no specific text that recommends giving them to believers. Fourth, giving kafarat oaths to ahl al-dzimmah (non-Muslims) in terms of maqâshid syariyyah is almost the same as giving zakat to converts, namely to persuade their hearts to Islam.</dc:description>
